Watergate Special Prosecutor Archibald Cox writes about Executive Privilege, a formality President Nixon attempted to invoke to avoid turning over critical White House tape recordings that implicated Nixon in the scandal. "Two days later, on October 12, the Court of Appeals rendered its decision. Like Judge John Sirica, it rejected the claims of Presidential immunity and absolute Executive Privilege. The opinion acknowledged that Presidential conversations are normally to be regarded as privileged, but held that the normal privilege must yield ?in the face of the uniquely powerful showing made by the special prosecutor in this case' that the tapes were evidence ?peculiarly necessary' to the grand jury's Watergate investigation. The opinion laid down the procedure to be followed, with active participation by the Special Prosecutor in separating the admissible from the privileged parts of the tapes. Later, Special Prosecutor Leon Jaworski would subpoena a second set of tapes, and the U.S. Supreme Court would approve the core of the earlier decisions by Judge John Sirica and the Court of Appeals." Typed statement signed by Cox. No date. Excellent condition.
